Why Won`t Debra Bowen Do Her Job?


(Privacy for All Students) When I volunteered to be the proponent of the referendum to overturn the co-ed bathroom law, I knew that it would be a tough task.  While the majority of Californians instinctively know that boys and girls should not be forced to share bathrooms, locker rooms and showers, a vocal minority was making sexual integration of bathrooms their cause.


But I did not know that I would also be fighting so many government officials along the way.  Perhaps I was naive in believing that employees in county registrars offices and the Secretary of State were supposed to be unbiased in doing their job.  Unfortunately I was wrong.

As most of you know, as the proponent of the referendum, I had to sue Debra Bowen, the California Secretary of State, to force her to count signatures thrown out in two northern counties.  The facts were shocking.  In one county a Federal Express delivery person was turned away at the county mail room.  He was told to come back several days later, after the deadline to submit signatures.  He brought the package back as directed and the Secretary of State said those signatures would not be counted.  Bowen ignored the action of the county employee and simply said that the signatures were turned in too late. 


The judge in Gina Gleason versus Debra Bowen saw it differently.  He was emphatic that the Secretary of State needed to count those signatures.  His preliminary judgment was so strong that the Secretary of State and her attorneys did not even show up for the hearing.


More than two months have passed since that ruling.  In that time the full count of signatures was completed and PFAS was told that we were 17,276 signatures short of the number needed to qualify.  It was assumed we would cry a few tears and move on.  But we knew that there were easily 17, 276 improperly rejected signatures in the more than 131,000 that were tossed out.  And we would fight for those just as we had for the signatures Debra Bowen threw out in those two northern California counties.


This week we were notified that the Secretary of State was going to appeal the ruling in Gleason v. Bowen


Perhaps it is because she knows that we will be able to identify more than enough improperly rejected signatures. 


Perhaps it is because she knows that the appeal will cost us time and money while her legal team comes free of charge from the State. 


Perhaps it is a way to delay reimbursing PFAS the legal fees we spent in her earlier loss in court.


But I am not giving up.  In fact, I am going to take every opportunity I can to point out that the Secretary of State is acting much more like an advocate than a referee.


And I am going to ask you to show the Secretary of State that we will not be bullied


This fight is far from over.  Please help me assure that this latest outrage from the Secretary of State will not drain our funds.  Please donate to keep our team fighting to qualify the referendum and to fight back against the shameful tactics of our government officials.

What Are they Hiding?


More than 131,000 referendum petition signatures were thrown out by elections officials throughout the State.  That was more than one out of every five.  But the law allows me as the proponent of the referendum to examine these signatures and to challenge them.  And I am allowed to authorize others to help me with that task in the 58 counties.

We knew that his would be a difficult process. 

We even figured that some employees in each county would take it personally as we search for mistakes, misapplications of the law or even deliberate rejection of valid signatures.

But PFAS did not expect the hostility and intimidation that we are now receiving.

In some cases, it has been a challenge just to get past the front door.  In one county our entry was delayed for more than a week as election officials argued (without any basis) that it was their right to delay the examination for up to three weeks.  They added that once they did allow the examination to begin, they could only handle two people at a time to review thousands of rejected signatures.

In many counties we have been allowed to examine the invalidated signatures so long as we do not touch any document.  In one case, staff even tried to enforce their personal rule that we could not take notes or we had to sign detailed documents that limited our legal rights.  No county yet has agreed to voluntarily allow PFAS to make the copies that we will need as evidence when these signatures are challenged in court.

Of course PFAS is standing up to these bullying tactics.  We have a team of attorneys that is addressing the ever-changing rules and obstacles that are being introduced at each county.

But there is a level of bullying and intimidation that should not be tolerated.  That level may have been reached yesterday in Sacramento where volunteers were pulled away from their examination and asked to wait in the lobby for more than three hours before they finally went home.

The reason they were pulled away from examining signatures was a sudden change in rules.  As proponent of the referendum, I had provided authorization forms to our volunteers throughout the State.  The form and my signature are copied.  While that was sufficient for entry for several days, now Sacramento had decided that the signature needed to be "wet ink".  While they backed off later, they were arguing that I either need to be there in person or have hard copy documents delivered.  No FAX.  (This was odd since these officials have been accepting and rejecting petition signatures by comparing these to electronic copies they have on file.)

That was a delaying obstacle, but the next revelation was pure intimidation.  Sacramento election officials offered to give a list of those who were authorized and unauthorized to one of our volunteers.  But first they had to make a copy for the ACLU. Apparently the ACLU had requested and Sacramento was giving them the names of each person authorized and not authorized to examine signatures.

Put another way, while elections officials were delaying the right to challenge signatures by making volunteers sit in a waiting room, there was no delay in delivering the names of those volunteers to an outside group.

Privacy For All Students began this fight a little more than six months ago with the simple notion that forcing boys and girls to share a bathroom was bullying.  Legislators with their sex separate facilities were bullying school children by forcing them into a situation that compromised the children`s privacy and safety.  Now election officials and the ACLU have joined the gang of bullies that wants to intimidate anybody that objects to their radical social experiment.

Constitution versus Convenience


(Privacy for all Students) From the beginning we assumed that it would be a challenge to gain the necessary signatures to qualify the referendum to overturn California`s co-ed bathroom law.  Not because we did not have the necessary support--polling showed that the public overwhelmingly believed that this new law was an assault on privacy and safety.

The challenge was in the short period of time to collect 504,760 signatures.

And the challenge was in getting out the truth about this law, and just getting the public to believe that the California Legislature would bully boys and girls into sharing bathrooms, locker rooms and showers.

But at PFAS we did not realize how many obstacles would be thrown at us by our own government.

On Monday, the Secretary of state reported the results of the full count of signatures from the 58 counties.  As reported, government officials threw out as invalid over 131,000 signatures.  For most of us, it is difficult to believe that more than 131,000 of our neighbors are not registered to vote but signed the petition anyway.  And our initial research over the last few days proves that we had reason to be suspicious of these results.

In fact signatures were thrown out for various reasons, many of which would shock most fair minded people.  As the process continues we will tell you more about why your signature may be one of these arbitrarily determined to be invalid.

But there is another troubling aspect to this referendum process.  While the right to "the people`s veto" is clearly laid out in the California Constitution, some in our State and local governments appear to favor convenience over the Constitution.

Right now we are in the period where the proponent of the referendum and her agents are allowed to examine the invalidated signatures and challenge why so many were invalidated.  But not every county has yet granted access.  Some has let us in but greatly restricted that access and our ability to examine "invalid" signatures.

Our desire to see these signatures and the explanation for throwing them out is viewed as highly inconvenient.

But if they believe we will become frustrated and give up, they are wrong.

We intent to fight to have every valid signature counted.

As we have told you many times, this stage of the battle is so important but will also be very expensive.  But the task of changing a little more than 17,000 signatures from bad to good looks doable--even though it will take a fight.
